Copyrights
We advise clients on copyright law, facilitate copyright registration and defend our clients in court and before arbitration panels on copyright-related matters. Our team is also frequently called upon to negotiate and draft copyright agreements for a range of works – for example, books, databases, digital content, fabric and wallpaper design, fragrance, jewelry, software and works of visual art.
Examples of our work:
- Defended international apparel company and retailer against copyright infringement claims arising from use of allegedly copyrighted artwork.
- Defended grocery chain against copyright infringement claims over the use of allegedly copyrighted photographs.
- Represented leading publisher of psychological assessment tests in copyright dispute with well-known fashion magazine publisher.
- Negotiated and drafted content monetization and distribution agreement for client in the sports and entertainment industry.
- Litigation in the US District Court for the Southern District of NY to enforce copyrights in our client’s fabric patterns and achieving a favorable settlement before trial.
- Defense of a client sued for trademark and copyright infringement of jewelry in the US District Court for the Northern District of NY and negotiating settlement before trial.
- Sent a cease-and-desist letter to the manufacturer of a blouse “knocking off” the client’s design, which was sold exclusively to an upscale retail chain, resulting in the infringing blouse being promptly removed from discount retailers.
- Represented the owner of rights in a collection of legal treatises in license negotiations with a large, global news service and research organization.
- Advised the heirs of a renowned French painter on complex legal matters regarding rights to the painter’s works and distinctive jurisdictional challenges.
