We rigorously defend and enforce our clients’ intellectual property rights, representing them in IP-related contract disputes as well as in federal court, at arbitration panels and before the Trademark Trial and Appeal Board. This includes drafting cease-and-desist letters and co-existence agreements, as well as negotiating favorable resolutions for a wide range of disputes.
Representative matters in our IP enforcement and defense:
- Successfully defended public company in the crowdfunding space in connection with a UDRP proceeding and precluded transfer of domain name.
- Favorably settled long-running trademark opposition proceeding on behalf of well-known travel accessories company.
- Defended international apparel company and retailer against claims of copyright infringement arising from use of allegedly copyrighted artwork.
- Defended grocery chain against copyright infringement claims over the use of allegedly copyrighted photographs.
- Represented leading publisher of psychological assessment tests in copyright dispute with well-known fashion magazine publisher.
- Assisted advertising agency with resolving claims under the Telephone Consumer Protection Act (TCPA).
- Represented heirs in a high-profile dispute over the ownership of certain jewels. Successfully secured partial summary judgment, establishing that the heirs’ ancestor was the prior owner of the jewels and that New York law, rather than Swiss law, governed the case.
- Secured a permanent injunction and favorable settlement in a trademark infringement and unfair competition action on behalf of a leading transportation and excursion service company, against one of the largest global operators of public transportation.
- On behalf of a leading global hair care line, successfully obtained dismissal of a declaratory judgment action seeking to establish trademark ownership and priority and then subsequently obtained a permanent injunction and damages for trademark infringement and unfair competition in client’s chosen forum.
